eMachines Computers Class Action Settlement
If you bought an eMachines computer after December 30, 1997 you may be entitled to a $365 class action settlement award.
In Stroud v. eMachines, Inc., plainitffs sued the computer maker alleging that they sold computers with a defective part that could cause the loss or corruption of data written to, or read from, a floppy disk.
As part of a class action settlement, consumers can receive a $365 credit for a new computer or trade in the credit for $62.50 in cash. No matter what you choose, you don’t have to turn in your old computer.

I acually purdhased 2 emachines,But only have 1 2008 the other 2009 which I still have.
I actually purchased 2 in that time period. One for myself and one for the man who is now my husband.
My family actually bought 3 emachines during black friday 2011 and all three of them the screen looks like it has been cracked. Lines go across the top to the right and down and is unable to be used. Not very happy with this. Thought my daughter had done something to hers but then my other daughter away at college said the same happened to hers and talking with my nephew he said the same has happened with his. Is this a defect or do they just not last for more than a year?
First of all this E machine settlement is not all that it is said to be. I received the claim form in the mail and after reading the fine print regarding the so called $365 credit for a “NEW” computer or accessories as this site states above is not true at all. You have to claim your $365 credit from a website called SECONDIPITY.COM which sells nothing but USED AND RECONDITIONED COMPUTERS, so you will not get a NEW replacement as stated above. So basically you can claim your $365 piece of second hand junk.
I read that part but in the grander scheme of things something is better than nothing. $62.50 cash or a used Ipad.
Not sure i like sending out a copy of my drivers lic is this a scam
Lori, I am with you. Why should we have to send a copy of our drivers license when they already have all of our info?
I bought our eMachine in 2000 / 2001. It was a piece of fecal matter from day one. There is no way I have any “proof of purchase” 12-13 years later. Yet, I too received two notices to my current address. We have moved since we bought the machine.
Either this is an elaborate scam or doomed to miss the people who actually bought their crap.
#1 The settlement agreement requires that the site will have new as well as refurbished.
#2 If you received postcard in mail you do not need proof of purchase. All you need is claim form using the identification number you were assigned and a driver’s licence with personal information blacked out (except for name and photo).
Just like many have stated, I too received a postcard. What I’m not comfortable with is why do I need to send in a copy of my government issued id. Even though we can black out everything except name and photo, one’s identity can still be stolen just w/that. Ref the movie Identity Thief. Even before that movie, I used to work for the federal government. In some of those travel briefings, you’ll be surprise what you learn what people can do w/just your photo and name — fake passports, fake ids in other states, etc. I tried to get a live person on the phone but it only gives you pre-recorded information. If they can honestly say what the ID is used for, I would understand. Why not make it stricter at the end — meaning if ordering from the site some are mentioning, must be ordered w/a credit card or debit card w/the same name or if sending a check, in order to cash the check, write “must cash in person and show proof of id” — that I could understand. Thinking about passing up on the again. Looked at it 3x since receiving it several months ago. Any other comments on this post are welcomed please, to help me ease my mind.
I have searched for the outcome of the 3/25/13 class action suit and can find nothing on the web. Anyone know the outcome?

I too am not comfortable with the drives license thing. I received several settlements over the past few years, and NEVER had to send a photo. I called the number on the card and it was ALL automated, no one to talk to… Wont be try to claim this….
and further more, i didnt buy the computer, my mom did (with her credit card) where did they get my name????????????????
That’s a good question. I read some other comments from other people in other forums and some people were saying that they moved several times and yet they still received a card.
I received a card and have not returned it yet. Not sure if I am going to due to the photo ID thing.
