On November 26, 2013, attorneys for both the the United States and Plaintiffs filed eight separate Stipulations of Dismissal, With Prejudice for eight of the named plaintiffs.
As you may recall, in June, Plaintiffs’ counsel filed a notice with the court indicating that of the 10 named plaintiffs, 8 had elected to participate in the administrative claims process, one had elected not to pursue her claims, and one was unreachable. Presumably, these dismissals related to the eight named plaintiffs who elected to participate in the Administrative Claims Process and are therefore releasing USDA from liability vis a vis the actual lawsuit.
Dismissal with prejudice means that the plaintiffs cannot sue again for the same claims.
This may mean that the lawsuit, as opposed to the Administrative Claims Process, is coming to a close.
