Ombudsman gets another $381,420.00…
On October 9, 2013, Judge Friedman issued an order approving the Ombudsman’s proposed budget for the period of September 1, 2013, through February 28, 2014 for $381,420.00.
The Court further ordered that the USDA shall, within 20 days, provide the United States Department of the Treasury with all necessary forms and documentation to direct a payment in the amount of the approved budget to the “Designated Account”. Finally, the Court ordered Class Counsel, within fifteen days after the approved budget amount is deposited in the Designated Account, to deposit with the Clerk of Court the full amount of the approved budget.
However, on October 15, 2013, the Court realized it made a mistake and vacated the October 9th order. The Court replaced the order on October 15, 2013 with a new order that approves the same budget amount. However, the Court Registry already has enough surplus money to cover the entire $381,420.00 proposed budget so there is no need to direct the USDA or Class Counsel to do anything further.
Apparently the Ombudsman feels it will be doing $381,420.00 between September and February. Your guess is as good as ours as to what that work is but they will be paid for it. Denied claimants will not have access to any of the $381,420.00.
