On June 11, the Court denied USDA’s Motion for an Extension of Time to file and Motion for Transfer of Venue.
The Court ruled on technical grounds stating that USDA did not follow court rules requiring: 1) all motions to submit a proposed order with the motions; and 2) all non-dispositive motions to contain a statement that counsel have conferred with the opposing side about the motion before filing.
The Court denied the motion without prejudice meaning the USDA could refile it if they comply with court rules.
UPDATE: On June 11, 2013, USDA filed a new Motion for Extension of Time that complies with Court Rules. Today, the Court granted USDA’s motion and ruled that the deadline for USDA to file any motion to transfer venue as to any remaining named plaintiff be extended until two weeks after the Claims Administrator has made a final determination as to whether the administrative claim filed by the eighth named plaintiff is complete.
