Plaintiffs in the Hispanic Farmers case, similar to the Women Farmers case, filed a complaint alleging that the administrative claims process set up by the USDA was unfair.
The District Court dismissed both complaints.
However, the Cantu plaintiffs have appealed the dismissal in the Court of Appeals. A victory there could mean another chance at class certification in the lower court. The Court of Appeals moves slowly, however, and it could be months or years before a decision is reached.
In the meantime, March 25 remains the deadline to participate in the administrative claims process for Hispanic farmers who wish to do so.
